Craigslist Blocks Oodle

When I wrote about Oodle a while back, I wondered if the sources of its listings would ever get cranky (Oodle scrapes classified listings all over the web, then creates a vertical search engine). I never thought the first grump would be craigslist – but indeed, the company has asked Oodle to stop scraping its listings. It feels counter to the vibe craigslist has always had. I’ve asked Craig for his reasoning, will post if/when he responds…

    Another interesting question: why does Craig still allow Indeed.com to scrape its job listings, but not Oodle?

    Is this the start of something as far as all the classified aggregators are concerned, or did Oodle do something particularly egregious, at least in Craig’s view?

    The next question is … how will this affect Oodle’s business business model, since I had assumed CraigsList represented a significant percentage of their listings. (At least it appears that way when searching their NYC listings.)

    1. Just because you put out an RSS feed doesn’t mean people can do anything they want with it. Craigslist can put out RSS feeds for users but not for people to build meta-sites on their backs.

    2. I guess is very “non-Web 2.0″ of me to say, but kudos to Craig. He spent 10+ years building Craigslist and is under no obligation to have someone else photocopy it and build a “meta” business off of it.

    I for one am sick of people saying something is Meta or Web 2.0 when what they really means is it’s based on stealing.

    We battle daily with people who are build “meta” sites by taking our content and Boingboing, Gawker, NYT content, wrapping it with their ads and saying “it’s a meta site!”

    Fair use is one thing, wholesale scraping/syndication is another. Oodle, Indeed, etc. should a) get permission and b) consider paying Craig a licensing fee for his content.

    Just like these folks, Oodle just displays summaries that direct its users to Craigslist and other classified sites.

    I agree with gina that almost all web search engines could be classified as ‘meta’ engines.

    Are we making a distinction between screen scraping and crawling? Crawling points the user right back to the original crawled content. In contrast, screen scraping repackages the content and cuts out the original source of the information.

    So, where do I classify myyahoo’s and google’s feedreaders which grab RSS based content and show it to me with all their other properties?

    Are they or should they be paying the bloggers for this enrichment of their content?

    Actually, Google does give you the ability to opt out of the index. This makes sense for some folks who would have the total value of their product in the abstracts Google “publishes.”

    In fact, the news companies felt they were losing value by the nature of Google News recently (a stretch, I know) and they are suing/opting out.

    At the end of the day there are two things to look at:

    a) fair use
    b) being fair

    It seems to me a lot of the meta sites are just leveraging the base of craigslist ads in order to get people to place ads on their service. When they reach critical mass they won’t need craig any more. That’s what I think is going on, and I’m sure Craig sees that too. It’s craigs community and if he doesn’t want it scraped they should–and did–respect that.

    What’s getting lost here is what’s best for consumers. I think being open is good for consumers.

    People want to see all their options. This is especially important for classifieds:
    - the market is fragmented
    - listings are perishable inventories of one (a job opening, available apartment, used car)

    If I’m looking for an apartment and don’t see the listing for my dream place, it’s gone and I never even knew about it. Comparatively, this is much less of an issue when I’m shopping for a new digital camera (where I can go into any one of ten stores and buy what I want).

    A similar argument can be made for consumers placing ads. They want to reach the biggest audience so they can get the best deal. Services like Oodle that help bring prospects to consumers listings are helping them not hurting them.

    I believe that Craigslist has the right not to work with Oodle. But by helping consumers find listings on Craiglist, I believe Oodle positively contributes to their service.

    This is a great example of the kinds of disputes I think we’re going to see as the web2.0 mashup phenomena grows. Is the very act of publishing *publicly available* RSS tacit permission to use the feed (note: it quite possible and increasingly common to protect access to RSS)? How does a publisher craft a TOS that can encapsulate all of the new uses for syndicated content that we are seeing? Isn’t the whole “web2.0 ethic” that it is these unforseen uses that create value for all parties?

    Or is that a lot of Jonestown kool-aid? ;-)

    As someone who does well in the directory business I think it is entirely up to the creator of the content. I publish a LOT of fair use material and in three and a half years have received exactly two requests for uninclusion but get many, many requests everyday for inclusion.

    If one scraper is using too much from one source it DOES become infringement and competition. I’m not familiar with Craigslist’s specific beef with Oodle, but I suspect that’s it.

    When looking at whether and how New West should re-publish content from other local sites, I discovered that Craigslist not only has an explicit policy on republishing their data, they are one of the relatively small number of publishers who explicity state the terms of use for their RSS feeds, including the explicit permission to republish them for personal use and the explicit restriction from commercial use, among other definitions, attribution requirements, and so forth (full TOS here).

    First off, I applaud that thoughtful and thorough statement of policy, independently of whether I like the policy. I disagree with a previous commenter that publishing an RSS feed is an implicit grant of permission to republish, given that there are plenty of uses of that particular technology that don’t involve republication. RSS feed practice lives in a gray area, since unless otherwise freed (for example via a Creative Commons license), all content is protected by copyright (limited only by fair use doctrine), yet many publishers of RSS feeds are only too happy to get exposure, and many would-be republishers of this are very aware of this tacit form of permission. I’ve suggested to several folks at Creative Commons that they should consider offering one or more RSS-related license types, and I’m sure in any case we’ll see more policy and protocol developing around this generally.

    As for Craig’s actual policy, why should it be any different? It is a business, despite its folksy roots (or some would say pretenses), and classified ad content is its stock in trade. There may be times when republication of that content is deemed to be in their interest, but otherwise, if anything they’re probably not protecting it vigorously enough.

    As for the fair use / “it’s just like Google” argument, that’s for more legally trained minds to debate, but I wouldn’t personally bet on Oodle’s position holding up.

    I’ve been reading your responses here and on your blog, and while I understand your point, I think you’re being a little intellectually dishonest amidst your talk of “love-ins”…

    The problem with your service (and Indeed, and SimplyHired, etc. etc.) is that long term your business model disintermediates Craigslist and replaces it with… another intermediary. Your site.

    Your service may indeed be better long term, in which case it will likely be successful, but Craig is under no obligation to subsidize it for you.

    What’s getting lost here is what’s best for consumers. I think being open is good for consumers.

    As a broad overarching principle, sure. But the devil is in the details. As a consumer (and sometimes advertiser) myself – I think a successful and viable Craigslist is in my best interests, at least for now. I’ve found it to be invaluable (and I’m in a market where I have to pay to advertise.)

    In my opinion, content syndicators should do what they have historically done and pay a licensing fee if they want to republish original content for profit. Just because it’s on the internet doesn’t mean it’s free – even in the NEW, new economy.

    UC, what you’re forgetting is that oodle doesn’t RE-PUBLISH, it SEARCHES and directs BACK to the original content. It provides free traffic (yes, i see the whole debate about being just another intermediary, and how many intermediaries can you have?, goo quesstion, what happens to the advertising dollars?, do they just grow exponentially? my opinion- sure, the more places to advertise the merrier). In that sense, oodle is much less harmful (if at all) than services like Bloglines or any RSS reader, which allow you to read other people’s content which they themselves produced (unlike with craigslist, someone has to get paid to write a BBC, NYT, Gawker, you name it, article) allowing you to skip the ads, which are crucial to providing salaries for all those wonderful writers out there. Why does noone have a problem with that?

    Not if it allows someone to co-opt your model and take your traffic. A classified ad is only paid for once and if it is an ad for a unique item it is good for only one use. The buyer and seller really don’t care about the middleman–he must fend for himself or lose.

    If ads are viewed while aggregated with similar ads the aggregation is more valuable to buyers and sellers than the original sources and will attract more buyers eventually causing buyers to congregate at the largest market: oodle.

    Once Craigslist has lost this traffic Oodle can begin selling ads directly.

    Google has done this first, shown the way for oodle. Sellers in the free organic results lose out to the (usually) more relevant paid listings.

    Craigslist will lose its business if it doesn’t block oodle.

    hi lucky – no, I didn’t forget that. My statement was that the long term business model for Oodle (and the others I cited) disintermediated Craigslist.

    I base this conclusion on the fact that they all accept RSS feeds direct from advertisers. This is not, in itself, a bad thing at all. To the contrary, it’s arguably a next step toward the semantic web, which I would wholeheartedly support.

    The problem from a craigslist perspective, I think, is that if Oodle et al are sufficiently successful to develop a gravitational pull of their own, then why would anyone continue to pay to list on craigslist? Just set up an RSS feed and notify Oodle directly.

    I personally know at least a half dozen companies that spend large sums advertising their career openings on Hotjobs/Monster/etc. If they start seeing major traffic via SimplyHired and Indeed, I guarantee that they will be more than happy to pull their paid listings from these sites and pump their content direct to the aggregators.

    All of which is completely fine. Progress even. But it’s silly to expect Craig to facilitate the growth of a business that is clearly out to cannibalize his own without a plan in place to address the issues I’ve outlined above. And I stand by my assessment that it’s intellectually dishonest to feign confusion at Craig’s action – - his reasoning seems very clear to me, and I’m not even remotely involved in either business.

    On further review, I can see where you might have gotten confused. On the original Oodle blog post, Craig D says in regard to Craigslist: “We send them free traffic. We don’t compete with them by taking listings.”

    Which is nice, except that it doesn’t appear to be true.

    From the Oodle site under ‘Get Listed’: “Oodle will gladly add classified listings to our search index for free. By getting listed, you increase traffic to your listings.” Links follow to instructions for configuring ads in a feed and submitting to Oodle.

    So you need to submit your ads as a feed, rather than via a submit form. But relative to the point I was making above this is a distinction without a difference.

    These services _are_ competing with Craigslist, they’re doing it today, and for them to pretend otherwise is disingenuous.

    I, for one, have posted many times on craigslist over the past nine years. I appreciate the careful balance that the craig’s team has struck between commerce and community. They have purposefully chosen to build an environment cluttered with ads. They thought through their fee strategy. I care about the presentation of my listing within that community. I would not appreciate the taking of my listing out of that context and surrounding it with ads that may actually compete with and even diminish my post. I understand that any search can clip my ad, but that is not the same as the wholesale taking of my post from its community. Shouldn’t “Web 2.0″ still be about community. Or is it really about “maximum monetization” and beware to any site that underserves ads….

    Like it or not, a search engine is a legitimate tool as long – especially when it respects robots.txt or allows a removal of a site (and I understand that’s the case with oodle since craiglist blocked them, right?)
    Any claim that a search engine should get permission or pay for indexing publicly available content is not serious. No search engine today asks for permission. Does froogle asks for permission? No.

    Licencing fee: IF oodle WANTS to they can pay licencing fee. But its up to them. Again, as long as they respect robots.txt. If craiglist takes measures to prevent the content from being accessed and indexed, and oodle decides its worth a licencing fee to get that content back on their site then everybody should be happy.

    Public is free: Data that is publically available on the net is free. Thats the nature of publically acessible content. The fact that a machine reads the data and processes it is not important. The potential “damage” to a site is also of little relevance.
    What if a site writes “you can’t tell your frields about what you read here or quote it anywhere, on the net/blog/website or otherwise (street, home,..)”? Are you obliged by that statement? After all it is their content as some say, no? What right do you have to use their data outside of their site? isn’t that the same? As strange as it sounds, its exactly the same. Some may not like it and think it is too different but it is not.

    It is one thing if the data is copyrighted (or datarighted) and then being copied fully without linking to the source. But when the data is publically available and not copyrighted or is used only partially, and always links to the source (what sore refer to as fair use) it is a legitimate use.

    Oodle’s business model and traffic: It doesn’t matter what oodle’s biz model is. It is their issue. I am sure they are there to create value and profit from it. If craiglist can block oodle’s indexing, what is anyone complaining about?
    If Oodle gets more and more traffic – good for them. They are not stealing anyone’s traffic. If you are referring to search engine traffic they attain? – it is noone’s but the search engines. It is not stealing traffic.
    Stealing traffic is installing a trojan
    on a computer and redirecting URLs or affiliate ID.

    According to John’s post Craigslist has “asked” oodle to stop indexing their content and if oodle complies, fine.

    But there is a swift and sure technological fix that trumps dialog, Craigslist can simply block oodle’s bot (by IP or by user-agent) from the content. End of discussion.

    Good fences make good neighbors, with a nod to Robert Frost (fair use if not yet public domain).

    very interesting thread. I think one core proposition is hinted at by JC – Craigs List is viewed by its contributors as 1) “theirs” and 2) “playing the game with respect and care”. As such, I think Craig is right in calling issue to the flagrant attempts for others to engulf their community into a new model.

    Let’s be real here, Oodle is playing a game to make a portal buy his site, and Craig has created a community of substance and earned respect. I personally appreciate the stand Craig has made. It brings the issue of community content publishing ownership and distribution control to the forefront where it belongs.

    Hiding behind the fever and trendiness of web 2.0 is disingenuous, in my opinion. Capitalistic exploitation of openness is a beautiful and nasty double edged sword. Somewhere in here – and hopefully it’s in the center not off to the side – has to be the rights and expectations of the individual contributors.

    John, I’d suggest you find a way to take this debate to a serious place and try to organize a dialog that brings a growing base of opinion exchange and consoldation. It’s too important to let die into the recesses of your comment links.

    If John is too busy with other projects or is not interested, I’d like to be bold enough to propose my blog as an alternative starting point. I would be happy to take responsibility for finding a way to organize & consolidate as time passes. At the outset I think just having a static place to continue the conversation would be valuable.

    The reason I’m volunteering is because I started the blog with the intention of discussing exactly this topic and a few closely related others.

    I’ve been leaving it pass-protected for the time being because it’s still fairly new & empty, but I’d be happy to open it up if anyone is interested.

    Of course if John prefers to take responsbility for setting something up himself, then I politely defer to our current bartender. One way or the other, though, I would like to help make sure that the discussion doesn’t disappear – - the topic is too important.

    Interesting how market forces, value chains, disintermediation, trust, customer benefits, all play in this thread ~ very similar to the discussions when Yahoo was building google.

    I feel that this tutorial has already been held already (google, amazon, ebay) to name a few ~ develop a SOA, and yes export your business model. Craigs list needs to determine where it plays, in the head or the tail or both, but decide quickly.

    It is the second generation of disintermediation for classifieds. Craigslist should know: they’re toasting the daily newspapers. It is a good lesson in looking over your shoulder–someone is always there with their eye on your prize.

    So Craigslist has a brand, millions of users, and a valued user experience. They’ve worked hard to build what they have and they don’t want an ‘aggregator’ like Oodle getting a free ride? That’s fair, a Craigslist post is a Craigslist post, not an Oodle post. Defend the brand, keep market share. After all, brand and market share can take you a long way in most markets.

    However, doesn’t it seem likely that we’ll be able to find classified listings through Google/Yahoo/MSN Search in the near future? Surely the search guys are working to add ‘classified listings’ to their indicies. And Google can get your classified listing in front of more people than Craigslist.

    If Craigslist doesn’t let Google and Co. index their listings, they open themselves up to competition from services that do. (I’m not suggesting that Craigslist wouldn’t allow for this–maybe they already do, anyone know about this?). So lets assume they do, then what they’re left with is an application for getting your information online and into an index (how does relevancy get determined, by the way?); the indexing and search part is done by someone who’s better at it…not very differentiated in my view (seems like a dis-aggregated blog). There’s still the sense of community there, but I’m betting the neighborhood will feel like its changing.

    The argument that individuals or companies posting a listing such as job ads, want as wide a distribution as possible is bogus.

    For example, if employers wanted wider distribution they could place their ad in multiple places. The fact that they choose Craigslist, or any specific job site, is because they want to target that unique community, they don’t want a gazillion resumes. Craigslist is protecting its listers when it limits scrapping.

    Content is valuable, whether it is job listings or news. It is unique content that attracts attention.

    And content owners will increasingly start to glue their content down. What happens to the oodles of googles out there will be interesting.

    Hello,

    I have read alot of the posts and I must say it is very interesting how the internet is shaping up with content. I guess with all these new innovative search engines has anyone yet to have created a search technology based on contextual linguistics and not a generic weight system. With OODLE or Indeed or Simply hired providing content that is in the millions it would be nice to be able to “ask” these directories and have them return results with virtually 100% accuracy. As big as Google is and as targeted as their results are Google seems effective more along the lines of “keywords” and not contextual linguistic phrases. It seems Google maps uses something like this. Curious to know if something like this is in the works. Might be a benefit to the community as well as advertisers.

    I agree with the posters who draw attention to the fact that the aggregated postings on oodle (and anywhere else for that matter) derived from Craigslist REDIRECT back to Craigslist itself. Saying that oodle is getting a ‘free ride’ is as ridiculous as saying Google is getting a ‘free ride’ by essentially aggregating content that they do not produce and providing it to the consumer. Not only is it in consumers interest to allow this aggregation but it is also in the best interest for Craigslist itself – Craigslist actually gains traffic by increasing its visibility with ‘hooks’ on other sites.

    Keep in mind that the RSS feeds from Craigslist do *not* include images nor contact information so users will inevitably click back to Craigslist to see the original. This move is nothing more than a short-sighted and self-defeating attempt to make Craig’s List the only kid on the block. Within 5-10 years (if not sooner) metasearch sites like oodle will be the norm.

    A real solution would be for Craig’s list to pare the information offered in its feeds such that the entire text is not visible. This is the business model adopted by Yahoo and other feed offering content producers that guarantees the full original content is only visible at the originating source. For Craig’s list to take a more ‘propietary’ stance than many of these major (totally)for-profit corporations is both deploring and perplexing.
